 Up-Photo provides a free and paid image and photo hosting service as well as digital photo embellishments services and photo editing service. We give you everything you need to be able to upload and share the best possible photo online with friends, family, clients or business partners. Photo Hosting prices range from $0 - $3.95 per month.

Users of our photo hosting service may upload as many digital image, digital photos, digital photos album, digital scrapbooking images, wedding photo albums as they wish (within the limits of their membership plan) and can then let others view the photos by letting them know the url of the image. Our users are not limited to only host their different types of photos at a very reasonable hosting price, but they are allowed to create HTML Slideshow ,  Auction Image Gallery , 360° Spins , HTML Portfolio to be embedded and  shared on social media sites, blog, websites, forum, message boards, articles directories, classifieds ...

You are authorized to sign up for and use 1 (one) free account only per IP. Any members suspected of creating more than 1 (one) free account may have their accounts deleted and all photos removed at any time.

Our photo hosting service, digital photos embellishments services and photo editing are offered to those looking for personal or professional digital photo hosting. If any of your images use excessive bandwidth, we may delete the image from our servers with no prior notice and, at our discretion, suspend or terminate your account.

The following terms are set to let you know, what you as a member of up-photo.com must agree to in order to utilize our services for either personal or business use. Up-Photo.com provides you membership to our service based on the following terms:

Acceptance
This agreement becomes valid immediately upon registration of our service. Your continued use of up-photo.com will constitute your acceptance of this agreement.

Service Agreement
As the owner of your account you agree to assume full responsibility for the content of anything you post on this site and for any actions taken in response to anything you post on this site. Up-photo.com cannot be held responsible for misuse of its services.

The files uploaded by the user:

•shall not be fraudulent or involve the sale of counterfeit or stolen items;
•shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
•shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination, false advertising, deceptive practices, or securities transactions);
•shall not be defamatory, libelous, unlawfully threatening or unlawfully harassing;
•shall not be obscene (no nudity), contain child pornography;
•shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
•shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information
It is left to each individual user when uploading photo to abide by any applicable local, state, or federal laws, statues, ordinanced and regulations that may apply. Images reported or found to be in violation will be promptly removed, without notice from up-photo.com, and the user may be subject to account termination, without possibility of refund from up-photo.com for any unused account balances, nor recourse by the customer. Up-photo reserves the right, but is under no obligation, to monitor the content of this or any subsidiary sites to determine compliance with our policies.

Up-photo.com will cooperate with fully, and provide any useful information available, to any legal or governmental agency in the event of investigation into any legal or questionable violations by a customer.

No user will use specialized electronic devices or software in an effort to cause the site to operate in an abnormal manner.

When inserting photos on external websites, you must use the URL we provide for such use.

User passwords and login credentials are to be protected by the account owner. We will not be responsible for unauthorized account access in the event a password is protected by the user. If you suspect a person has accessed your account without authorization, it is your responsibility to change your password and contact up-photo.com immediately.

Users found to be otherwise abusing the system will be subject to account termination at the discretion of up-photo.com.

Digital Photo Embellishments & Photo Editing Service

When members sign up for digital photo embellishments or photo editing service, they agree to pay the additional monthly fee for the specific service besides the photo hosting plan. Members must use anytime during their plan time period, the contact form page, to upload the number of images allowed by their monthly plan to have their photos embellished or edited. The service to be performed on each photo must be detailed described by member. Each photo edited by us are allowed to one revision only.

If you are allowed to 10 photos editing in a month and you don't use it. You will not be allowed 20 photos editing on the next month. In other words, the service is not accumulative! We strongly advice to purchase digital photo embellishments and photo editing service plans when you know you will use it completely.

Outage
Although we strive hardly for 100% service availability, reliable and secure hosting service, up-photo.com offers no warrants or guarantees due to the nature of our service, an outage of one of  up-photo.com's servers may mean your pictures will not be displayed. By using up-photo.com as your photo hosting provider, you agree not to hold up-photo.com and its owners liable for any occurrence, including but not limited to, lost sales on ebay, penny auctions, ubid... and/or lost images. Even though up-photo will be backed back hourly to assure your photos are saved.We strongly recommend that you keep a backup of your images on your computers hard drive at all times. up-photo.com has no liability and will not be liable to issue any form of compensation. This includes all of the following, but is not limited to the following:

1. Lost ebay, ubid, penny auctions and others sales due to pictures not loading
2. Lost photo, image or account information from up-photo.com or user error
3. Refunds of membership fees because of outages and or hardware/software failures

Membership Fees
You agree to pay all monthly membership fees through paypal and in the event that you initiate a chargeback, up-photo.com will cancel your membership and any/all images or photo and personal information will be lost. The fees will terminate upon cancellation of our services. As the user is prepaying each month for our service in the event that you cancel your membership up-photo.com will not be held responsible for any money that was prepaid in advance.

In the event that our subscription price changes, and you would like to get our new rate please contact us and we will be happy to give you our new price. If our price goes up or down you will still pay the same price you are locked in at unless you contact us and request a change to our new price.

Refunds
Refund of any portion of unused subscription payments after an account termination on the part of the customer of up-photo.com will be at the discretion of up-photo.com.
